What is a pour-over will in a trust?

A pour-over will is a legal document that directs any assets left outside of the trust at the time of your death to be transferred into your established trust. For example, if you create a living trust but have your bank accounts under your name, alone, your pour-over will can directly add all missing assets to your trust after your death. Most families use pour-over will to avoid transferring everything to their trust while they are alive.

The most common question our wills and trust attorney’s face is “how does a pour over will work?” The simplest answer is that this legal document is a backup for any assets your purchased and were left out of your trust. For instance, if someone purchases a house but dies weeks after without adding them properly to their trust, a pour-over will automatically does that for you. If you don’t have a pour-over will and you pass away before transferring your new assets or bank accounts to your trust, those assets will go through probate. 

Finally, a pour-over will does not replace proper trust funding. Transferring assets into your trust during your lifetime is generally the better way to keep those assets from going through probate.

A pour-over will does not automatically avoid probate. Assets that are placed in your trust don’t need to go through probate. So basically, a pour over will transfer the missing assets to your original trust. Technically, pour-over will doesn’t protect your assets from probate alone. But combined with a living trust, your pour-over will acts as a concrete backup plan.
